4. Data processing when contacting us

You have several possibilities to contact us. You can contact our customer service by phone, fax or e-mail.

We also provide an IR contact form on our website. In this context, we collect your name, e-mail address, postal address, telephone number and other information that you provide to us.

You can apply for open positions using the contact forms provided on our website. The purpose of data collection is to select applicants for possible employment. In order to process your application, we collect the data provided by you (usually first and last name, e-mail address, application documents such as certificates and curriculum vitae, date of earliest possible start of employment and salary expectations). The legal basis for processing your application documents is Art. 6 Para. 1 S. 1 lit. b and Art. 88 Para. 1 GDPR in conjunction with § 26 Para. 1 S. 1 BDSG.

For this purpose, we pass on your personal data to a service provider in the field of applicant management (softgarden eRecruiting GmbH, Tauentzienstraße 14, 10789 Berlin (“softgarden”)).

(i) The softgarden recruiting platform offers the possibility to recommend potential applicants. Your profile photo as well as your name and the job you have applied for will be displayed. The legal basis for the processing of your data on the basis of a recommendation is Art. 6 Para. 1 S. 1 lit. f GDPR (legitimate interests). Our legitimate interest is to give our employees the opportunity to recommend known persons for open positions. This gives us the chance to make our applicant selection process more efficient.

The information about the recommendation will be deleted as soon as the corresponding application on the softgarden recruiting platform is deleted as well.

(ii) Following an unsuccessful application or by clicking the “Contact Us” button, you may be invited into our talent pool. We can then contact you if a similar or otherwise suitable job is available. The inclusion in the talent pool is voluntary on the basis of the use of an opt-in link. When you sign up for the talent pool using the "Get in touch" button, we require the following data from you:

  • Salutation, academic title (optional).
  • First name, last name, e-mail address
  • Job fields of interest
  • Current career level
  • Preferred location(s)
  • XING profile or resume

The legal basis for this is the consent of the data subject in the inclusion in the talent pool within the meaning of Art. 6 Para. 1 S. 1 lit. a GDPR. You can withdraw this consent for inclusion in the pool at any time with effect for the future. Furthermore, we will contact you after 12 months to confirm whether you still want to be part of the talent pool.

(iii) In certain constellations, personal data is also collected from third parties or processed by third parties. This includes, in particular, cases in which we are obliged to collect or pass on data due to legal regulations. This applies in particular to applicant screenings in accordance with EU anti-terrorism and anti-money laundering regulations and for the enforcement of sanctions. The legal basis for processing your data in this case is Art. 6 para. 1 lit. c DSGVO.

6. Secure data transmission and data security

Your personal data will be transmitted securely by us through encryption. We use the TLS (Transport Layer Security) coding system. In addition, we protect our website and other systems against loss, destruction, access, alteration or distribution of your data by unauthorised persons through technical and organisational measures.

7. Your rights

You have the right of access to your personal data processed by us at any time. In this context, we will explain the data processing to you and provide you with an overview of the data stored about your person. If data stored by us is incorrect or no longer up to date, you have the right to have this data corrected. You may also request that your data be deleted. Should deletion not be possible in exceptional cases due to other legal provisions, the data will be blocked so that you are only available for this legal purpose. You can also have the processing of your personal data restricted if, for example, you doubt the correctness of the data. You also have the right to data portability, i.e. we can send you a digital copy of the personal data you have provided on request.

In order to assert your rights described here, you can contact us at any time at the contact data listed under point 1.

You have the right to revoke your consent to us at any time. The consequence of this is that we will no longer continue the data processing based on this consent in the future. The revocation of the consent does not affect the legality of the processing carried out on the basis of the consent up to the revocation.

If processing is necessary for the purposes of legitimate interests pursued by us, you have the right to object to the processing of your data at any time for reasons arising from your particular situation. If you wish to object to data processing for direct marketing purposes, you have a general right of objection, which is also implemented by us without stating reasons.

If you wish to exercise your right of withdrawal or objection, simply send an informal message to the contact details listed above.

Finally, you have the right to lodge a complaint to the data protection supervisory authority responsible for us. You may exercise this right with a supervisory authority in the Member State in which you are staying, in which you work or in which the alleged infringement occurred. The responsible supervisory authority is: Data Protection and Freedom of Information Commissioner of the State of Berlin, Friedrichstr. 219, 10969 Berlin.
